The exchange certifies its own product and may list it the next business day; the regulator never has to say yes, so a certification tells you who filed, not who agreed.
Filing entity: QCX LLC, trading as Polymarket US; registry organisation code QCEX
DCM designation: designated 9 July 2025, CFTC register record 49571
Mechanism: 17 C.F.R. section 40.2, self-certification; section 40.3, voluntary approval
CFTC register: https://www.cftc.gov/IndustryOversight/IndustryFilings/TradingOrganizations/49571
Start with the mechanism; it outlasts the news. CFTC Regulation 40.2 "permits designated contract markets to list products for trading without prior CFTC approval by filing a written self-certification," the agency's listing-procedures guidance states. The exchange files by close of business the day before it intends to list. The submission must carry the product's rules, a certification that it complies with the Commodity Exchange Act and CFTC regulations, and a "concise explanation and analysis" of that compliance. In filing, the guidance says, "a DCM certifies that the product does not violate any provision" of the Act or the agency's rules.
The certifying party is the exchange. Affirmative approval is a separate, voluntary route under Regulation 40.3, and the guidance is explicit that a product "may be listed prior to approval." Regulatory silence is not assent.
Against that, the news. On 26 August Polymarket US certified bitcoin, ether and solana price event contracts, each classified as a swap in the binary option subcategory, Bitcoin.com News reported after reviewing the CFTC's product registry; TokenPost described the same three entries. CoinGape and Noah Intelligence reported they are yes-or-no contracts on whether a price sits above, below or within a stated level at a stated time, settling on CF Benchmarks data. The same day it withdrew two NFL player participation filings certified a day earlier.
One limit is worth stating plainly. The CFTC's register confirms QCX LLC, trading as Polymarket US, is a designated contract market, and its guidance sets out the route above. The three crypto product records themselves are not public at the register level, so the certified status of these contracts rests on the outlets that viewed the CFTC product registry rather than on the filings.
What the filing does not establish is longer. It is not a launch: CoinGape reported the certification cleared a path to listing as soon as 28 August, but a venue being cleared to list is not evidence that it did, and no exchange announcement or CFTC record shows trading has begun. It is not approval: no CFTC order blesses these contracts, and the CFTC's Division of Market Oversight warned on 24 July that broad, template-style certifications limit its ability to judge whether a DCM supplied the analysis Regulation 40.2 demands.
Nor is it disclosure: the compliance analysis for the withdrawn NFL product was filed under a request to seal it in perpetuity, Bitcoin.com News reported. There are no volume, open interest or user figures. Sibling DCM Kalshi lists on the same mechanism — which is the point: it is common, and it certifies nothing about the regulator's view. A federal appeals court reached that conclusion about Kalshi's own self-certification in August.
Also: the CFTC ordered a former White House teleprompter operator, Gabriel Perez, to pay about $172,000 and banned him from trading for three years over event-contract insider trading. The order finds he traded presidential “mention market” contracts on speech wording he had seen in advance. The agency thanked KalshiEX for its assistance, which is the part worth noticing: the venue policed the trade, not the mechanism that listed it.
